Note from the Founder

At FNA, we recognise two forms of cultural authority - Traditional Authority, grounded in kinship, Country, and lineage, and Contemporary Authority, built through experience, expertise, and leadership within modern systems. Both carry weight and responsibility. The problem is how often either is claimed without accountability, or borrowed to legitimise work that doesn’t meet cultural or ethical standards. We’ve seen growing confusion and exploitation of these forms of authority. Identity has become a credential, often separated from the obligations and accountability that should accompany it. Institutions are using cultural association to legitimise activity, particularly where funding and procurement incentives apply. Across the sector, we’re seeing the language of identity and representation grow louder while responsibility and obligation fall quiet. Cultural legitimacy is responsibility. It is demonstrated through integrity, accountability, and service to community. When authority is exercised without these principles, it ceases to hold legitimacy no matter how visible it becomes.

Three ways to strengthen cultural legitimacy in practice

1. Map where authority actually sits.

Look beyond position descriptions and committees. Identify who is making decisions that affect First Nations outcomes and whether those people hold recognised cultural or professional authority to do so.

2. Differentiate the type of authority required.

Some decisions require Traditional Authority - grounded in kinship, Country, and cultural responsibility. Others rely on Contemporary Authority - built through expertise, governance, or leadership roles. Knowing which applies helps ensure the right people are engaged at the right level.

3. Embed obligation into governance.

Build accountability into your systems. Cultural legitimacy isn’t maintained by statements, it’s upheld through reporting, reflection, and continuous oversight by those with authority.

Governance Reflections

Cultural legitimacy is emerging as one of the most critical, and misunderstood, elements of organisational governance in Australia. It determines whether partnerships, programs, and strategies are grounded in genuine authority or built on appearances. In governance terms, cultural legitimacy serves as the bridge between policy intent and lived accountability. It defines who holds the right to speak on matters of Country, community, and culture, and ensures that authority is exercised with accountability rather than assumed through position or identity. Organisations that fail to recognise this distinction often fall into patterns of tokenism, duplication, and performative inclusion. Establishing culturally legitimate governance provides the structural scaffolding for integrity, trust, and effective leadership.

Climate, Finance, & Policy

In ESG, human rights, and international relations, much is made of social licence - the trust and acceptance that allow projects and institutions to operate with public support. It’s often treated as reputational currency: something to be managed rather than earned.

In Australia, there’s another layer that’s rarely articulated - cultural licence. This goes beyond a Welcome, an Acknowledgement, or a Reconciliation Action Plan. Cultural licence is the legitimacy that comes from operating within the authority of those who hold rights, knowledge, and responsibilities on Country.

Without cultural licence, social licence is fragile. Organisations can speak about inclusion or partnership, but if the authority structures behind those relationships aren’t legitimate, the foundation is weak.

For sectors tied to ESG, human rights, and investment, this distinction matters. Cultural licence can’t be borrowed or performed. It must be earned through governance, accountability, and respect for cultural authority.

For organisations serious about sustainability, human rights, or investment integrity, cultural licence is the precondition for trust.
